Section XXII - User Generated Content

 

''Users generated content'' means as defined below, comments, messages, emails, data, text, information, photos, sounds, music, images, graphics, video or audio clips, files, drawings, icons or other material or content generated by a third person other than Barbaware. The term ''comment'' is relative and mean comments, opinions, feedback, ideas, questions or suggestions. ''Interactive Areas'' means when any advice or interaction can be done by a third person on forums, blogs, message boards, chat areas or other interactive areas in which you or other users may post comments, this includes all Barbaware pages on social networking sites and web pages such as Twitter or Facebook.

General

When distributing, publishing, displaying or sending user-generated content on our sites you:
 

1) Allow Barbaware the transferable, irrevocable, perpetual, fully paid, non-exclusive, worldwide, sublicensable, license to use, reproduce, copy, modify, adapt, translate, transmit, upload, publish, rent, create, sell, display, perform, transmit, disclose, or incorporate into other works the generated content imported by users to any purposes, to the extent permitted by law.
 
 

2) Allow Barbaware the right to use your name in connection with the content generated by the user, subject to our Privacy Policy.
 
 

3) Declare and warrant that:
 

a) You own and control all proprietary rights contained in the content that you generated on our platforms
 

b) The content that you generated is accurate, complete, not misleading and does not violate the applicable laws and regulations.
 

c) The use, display, and publication of such content does not violate the terms of use and may not violate any rights of or cause injury to another person or entity.
 
 

4) Allow to Barbaware the right to sue any person or entity that violates Barbaware under any applicable law regarding the content generated by users.

The content generated by the user is recognized not confidential and Barbaware is under no obligation to treat such content as confidential. Without limiting the foregoing, Barbaware reserves the right to use the content generated by users as it deems appropriate, including, without limitation, rejection, limitation, suppression or refusal to publish. Barbaware has no obligation to grant you paternity content or to pay you for such content. If, however, under any applicable law, it is determined that you conserve moral rights contained in the generated content on our websites, you agree that:
 

1) You will not demand that your personal information is used in connection with the content that you generated.
 

2) You will not object to the use, publication, modification or deletion of the content by Barbaware.
 

3) You give up and claim any and all moral rights in any part of the content generated by the user, to the extent permitted by applicable law.

Interactive Areas

These websites may contain interactive areas. If Barbaware provides such interactive areas, you are solely responsible for the use you made of these interactive spaces and you agree to use them at your own risk. For example, without limitation, you agree that when using an interactive area, you will not publish, upload, convey, distribute, stock or create content with one of the following characteristics:
 

A) Any content, information or materials that are incomplete, false, inaccurate or that is not yours.
 

B) Any content, information or material that violates or infringes the copyrights, patents, trademarks, service marks, trade secrets or other proprietary rights of any person.
 

C) Any content, information or material that is defamatory, obscene, indecent, threatening, pornographic, explicit, violent, illegal, indecent, harassing, invasive of the privacy or the rights of a third, abusive, fraudulent or otherwise objectionable, or that could give rise to civil or criminal liability under Canadian or international law.
 

D) Any content, information or material that includes viruses, worms, bugs, traps, Trojan horses or other harmful code.
 

E) Any content, information or material that violates the laws and regulations in Canada or in any other jurisdiction.
 

F) Any content, information or material that advertises or links to other commercial websites.
 

G) Any content, information or materials containing names, postal addresses, email addresses, SIN, driver's license information, telephone and fax numbers, information on the identity, credit cards, passport or other personally identifiable information.
 

H) Any content, information or material that contains corrupted data, disruptive, destructive or other harmful files.

Under applicable laws and to the possible extent, Barbaware is not responsible for the content generated by the users, for any loss or damage, mistakes, defamation or any other offensive things you can encounter in ties of a violation of these terms and conditions by a third party. In terms of an interactive area single supplier, to the extent permitted by law, Barbaware cannot be held responsible for the content generated by his users. Barbaware has no legal or contractual obligation to modify, filter or monitor the content generated by the users. However, Barbaware reserves the right, and at its sole discretion to remove or edit any content generated by its users on these sites without notice for any reason whatsoever.

Comments

Ownership of all comments posted, uploaded, posted on Barbaware websites will be automatically transferred to Barbaware and become the property of Barbaware. Barbaware will then be subject to any obligation:
 

A) To pay compensation for any comments.
 

B) To assign you your comments.
 

C) To reply to comments.

Barbaware do not wish in any way receive feedback information including confidential, secret or proprietary. Therefore, you acknowledge and agree that all the comments that you provide to Barbaware are not or will not be in violation of this these terms and conditions.
